The application, submitted to the U.S. District Court for the Central District of California, proposes moving the tax evasion trial from June 20 to September 5. Alternatively, Mr. Lowell suggests an earlier status conference to address the matter.
Recent setbacks for Mr. Biden include unsuccessful attempts to halt proceedings and pursue appeals in his California tax evasion and Delaware gun cases. Mr. Lowell, his lead attorney, faces significant difficulties in preparing for both trials simultaneously, as stated in the filing.
Challenges include delays in securing expert witnesses and the need to communicate with witnesses across various states. These obstacles, compounded by ongoing appellate litigation and Delaware trial preparation, hinder counsel’s ability to provide effective representation.
Mr. Biden’s legal team argues that denying their request for a continuance would deprive them of the necessary time for preparation and representation. Additionally, scheduling conflicts arise from Mr. Lowell’s personal matter, as he wishes to attend his friend’s funeral on May 29, coinciding with the pretrial conference.
The filing acknowledges the logistical complexities involved in managing both trials and justifies the ex parte application due to imminent or missed pretrial deadlines. The impending trials in June—on June 3 for the Delaware case and June 20 for the California tax evasion case—compound the scheduling challenges.

A California grand jury indicted Mr. Biden on nine counts, alleging funding of a lavish lifestyle through drugs and prostitutes instead of paying taxes.
The timing of this request follows Mr. Biden’s unsuccessful legal maneuvers to halt proceedings and pursue appeals, with the Ninth Circuit Court’s dismissal of his motions clearing the way for trial as scheduled.
A response from Special Counsel David Weiss to the ex parte application is anticipated by May 17.
