The GOP’s knack for seizing defeat from the jaws of victory was on full display recently as a critical Senate vote saw several Republican senators absent, allowing a contentious judicial nomination to pass.
Earlier this year, U.S. District Judge Nancy Maldonado of the Northern District of Illinois faced a turbulent Senate hearing for her nomination to the Seventh U.S. Circuit Court of Appeals. During the hearing, she struggled with basic questions on gun laws, despite having previously advocated for the abolition of “assault weapons.”

On Monday, eight Republican senators were conspicuously absent, enabling Maldonado’s confirmation with a narrow 47-43 vote. Their absence meant that the votes of Democratic Sen. Joe Manchin of West Virginia and Independent Sen. Kyrsten Sinema of Arizona, who were prepared to oppose the nomination, went unbalanced.
Judicial Network President Carrie Severino criticized the eight Republican no-shows, alongside Democratic Sens. John Fetterman of Pennsylvania and Bob Menendez of New Jersey, stating, “Democrats just promoted a radical and incompetent judge to a lifetime position on the Seventh Circuit Court of Appeals with only 47 votes. How? Because 8 Republican Senators didn’t show up to vote against Nancy Maldonado.”

Severino emphasized the urgency for Senate Republicans to present a united front against nominees deemed a threat to constitutional principles, especially with less than six months remaining in President Biden’s term.
The absent Republicans included:
- Sen. Mitt Romney of Utah
- Sen. Marco Rubio of Florida
- Sen. Rick Scott of Florida
- Sen. Ted Cruz of Texas
- Sen. John Hoeven of North Dakota
- Sen. Markwayne Mullin of Oklahoma

- Sen. James Risch of Idaho
Mike Davis, President of the Article III Project, voiced his frustration, “Why the hell did so many Senate Republicans miss this critical vote? Manchin and Sinema voted against this Biden nominee. And Menendez is on trial in New York City. This radical Biden judge’s nomination would have failed. Now we’re stuck with her for the rest of her life.”
Some absences were accounted for: Cruz remained in Texas to assist with Hurricane Beryl relief, while Rubio and Scott were campaigning with former President Donald Trump in Florida. The reasons for the other senators’ absences were less clear, giving the impression they extended their Independence Day celebrations.

John Kennedy, who challenged Maldonado during her hearing on her stance on “assault weapons,” also highlighted her slow judicial performance, stating, “Of all 68 district judges confirmed last Congress, Judge Maldonado has the THIRD WORST record when it comes to issuing rulings in a timely manner. But Pres. Biden wants to promote her to an appellate court. Why?”
This sentiment resonated with voters who criticized the GOP for failing to take a stand against what they see as the encroachment of radical judicial appointments.
