Letitia James is facing a serious courtroom challenge over her role in the Cornell investigation. Attorneys for Gillio Lopes argue that James compromised her ability to conduct an impartial investigation when she publicly supported Jane Doe and referred to her as a survivor before being appointed special prosecutor. James says she was merely expressing empathy, while her office calls the bias allegations wildly speculative because no charges have been filed and the harms feared by Lopes have not occurred.
The judge did not remove or disqualify James—but the fight is expanding. Acting Justice James Farrell identified a procedural problem because Lopes was the only one of the seven accused men participating in the petition, and he gave the lawyers until November 5 to address the positions of the other defendants or bring them into the challenge. James has also hired outside counsel, which she says is standard for complex matters. We break down the questions raised about her original post, the defense’s removal attempt and why this hearing created a new battle without deciding the underlying allegations or anyone’s guilt.
